A Texas EIN is a federal tax ID issued by the IRS, and applying directly with the IRS is free. Whether you need one depends on your business structure, employees, and tax obligations.
Corporations, partnerships, and businesses with employees generally need an EIN. Some sole proprietors and single-member LLCs do not; the exceptions are explained below.
To apply: form your LLC or corporation first, gather the responsible party’s taxpayer ID and business details, then use the free IRS EIN application if eligible. Save the confirmation letter. Applicants who cannot use the online tool can apply with Form SS-4.

State or Federal Employer Identification Numbers
An employer identification number, or EIN, is a unique identifier assigned by the IRS for sole proprietors, partnerships, corporations, and non-profit organizations.
It is also known as a federal tax identification number (FTIN) and is used to identify your business for federal tax reporting and other business-related transactions.
A sole proprietor without employees may not need an EIN, unless another federal tax requirement applies. For a single-member limited liability company (LLC), the answer also depends on its federal tax classification.
A single-member LLC treated as a disregarded entity generally does not need a separate EIN if it has no employees or excise-tax liability. It generally uses the owner’s name and taxpayer ID for federal income-tax reporting. Banking, state-law, or special reporting requirements can still make an EIN necessary. See the IRS guidance for single-member LLCs.
Corporations and partnerships generally need an EIN even without employees. A multi-member LLC is generally taxed as a partnership unless it elects corporate treatment. A single-member LLC that elects corporate taxation also needs its own EIN.
A federal EIN is not the same as a Texas taxpayer number. The IRS issues the nine-digit EIN; the Texas Comptroller issues a separate 11-digit taxpayer number for state tax accounts.
State registration and tax-account requirements depend on the business and its activities. Do not treat an EIN as a sales-tax permit or assume it completes Texas tax registration. The Comptroller explains the two identification numbers.
Purpose of Employer Identification Numbers
An EIN identifies a business for applicable federal tax filings and can also be needed for banking or other business transactions.
Having an EIN does not, by itself, determine which tax returns you must file. Filing duties depend on the entity’s tax classification, activities, and other applicable rules.
Additionally, banks usually require an EIN to open a business bank account. An EIN helps separate business and personal finances, which is important for tax and liability reasons.
Further, if you plan to apply for a loan for your business, you will likely be asked to provide your EIN. Overall, having an EIN may provide your business with more credibility.

Consequences of Not Obtaining an EIN
Not obtaining an EIN can lead to several complications for your business. One major issue is that many banks require an EIN to open a business bank account. Without it, you may struggle to separate your personal and business finances, complicating your accounting and tax reporting.
If you hire employees, an EIN is needed for employment-tax reporting. Late or missing required returns, deposits, or payments can lead to penalties; applying for an EIN does not replace those duties.
When an EIN is required, obtaining it promptly helps avoid delays with filings, payroll, and financial accounts. Check your bank’s and lender’s documentation requirements before applying.
Confirm whether your business needs an EIN and which tax registrations apply. An EIN identifies the taxpayer; it does not create an LLC, provide liability protection, or establish that the business has met every tax obligation.
How to Get a Business EIN Number
Eligible domestic applicants can apply through the IRS online EIN application. There is no IRS application fee. If you are creating an LLC or corporation, complete state formation before applying.
The online tool requires a principal place of business in the United States or its territories and the responsible party’s SSN or ITIN. An authorized representative must have the required authorization. Review the IRS eligibility rules before starting.
Domestic applicants cannot obtain an EIN by calling the general IRS business help line. Telephone applications are available to international applicants under the Form SS-4 instructions.
If you cannot apply online, use Form SS-4, Application for Employer Identification Number, and the current IRS fax or mailing instructions.
Use only one application method for the same entity so you do not receive duplicate EINs. Keep the IRS confirmation with your business records.
An EIN is one part of setting up a business. Our Texas business formation attorneys can help you coordinate entity formation and governing documents, while your tax adviser addresses tax elections and reporting.
Frequently Asked Questions About Obtaining an EIN in Texas
How Long Does It Take to Receive an EIN?
An approved online application issues an EIN immediately. The IRS generally estimates about four business days for fax applications when a return fax number is provided, and about four weeks by mail. Processing times can change; check the current IRS instructions.
Is There a Cost to Obtain an EIN?
No, obtaining an EIN from the IRS is free of charge.
Can a Sole Proprietor Use Their Social Security Number Instead of an EIN?
A sole proprietor without employees may use an SSN if no other EIN requirement applies, such as certain excise-tax obligations. A bank may still require an EIN. Review the IRS requirements for your specific activities before deciding.
What Should I Do If I Lose My EIN?
If you lose your EIN, you can retrieve it by checking previous tax returns, IRS correspondence, or contacting the IRS directly for assistance.
Can I Apply for an EIN If My Business Is Not Registered Yet?
If you are creating an LLC or corporation, form it with the state before applying for an EIN. A sole proprietorship is different: whether a state filing is required depends on its name and activities. An EIN application does not register or form a business with Texas.
